IMPORTANT NOTE REGARDING THE ASSIGNMENT OF A MICRO-EMBEDDED GENERATION FACILITY CONNECTION AGREEMENT DUE TO A SALE OR TRANSFER OF OWNERSHIP OF A MICRO-EMBEDDED GENERATION FACILITY

An assignment is required when an owner intends to assign all of its rights and obligations under a microFIT procurement contract under which the output of a micro-embedded generation facility is sold to the Independent Electricity System Operator (IESO) (“MicroFIT Contract”) or the Micro-embedded Generation Facility Connection Agreement for the connection of the Micro-Embedded Generation Facility to Hydro One’s distribution system (“MECA”) to a different legal entity or individual(s).

If you have a MicroFIT Contract and a MECA, the assignment process involves a two-step process which includes two different companies. You will need to notify both the Independent Electricity System Operator (IESO) and Hydro One. For clarity, in order to submit a Contract assignment request to the IESO, you will need to follow the contract assignment process found on their website at https://www.ieso.ca/en/Get-Involved/microfit/Contract-Assignments. Regarding the Hydro One process, in order to assign an existing MECA both the Assignor and Assignee must agree, complete and submit an “Assignment and Assumption Agreement Application Form”.

If you (the “Assignor”) are selling or transferring the ownership of your property which has a micro-embedded generation facility connected to Hydro One’s distribution system, you will require:

  • the consent of the IESO in order to assign to the assignee your “MicroFIT Contract”;

  • to enter into an Assignment and Assumption Agreement and Micro-Embedded Generation Facility Connection Agreement Amending Agreement with Hydro One which includes the assignment of the “MECA” to the new Owner (“Assignee”).

Note:
If you have a MicroFIT Contract, the assignment of the MECA will not be effective until the IESO has approved the assignment of the MicroFIT Contract and notifies Hydro One of the “Assignment Effective Date”.

THE CUSTOMER IS SOLELY RESPONSIBLE FOR ENSURING THAT THIS TRANSACTION DOES NOT IMPACT OR AFFECT ANY CONTRACT THE CUSTOMER MAY HAVE WITH THE IESO. IN ADDITION, HYDRO ONE IS NOT RESPONSIBLE FOR THE CONTRACT TERMS AND AGREEMENT YOU MAY HAVE WITH THE IESO.
